Par un contrat de licence daté du 10 juillet 2019, l’auteur a cédé à l’association La Fresque du Climat le droit exclusif d’exploiter la marque française « La Fresque du Climat » et le jeu « La fresque du climat ». En conséquence l’association peut définir les conditions d’utilisation de La Fresque du Climat et collecter les redevances d’utilisation dans le cas d’un usage commercial ou dans la sphère interne d’une organisation. |
L’utilisation du jeu “La fresque du climat” dans un cadre professionnel (hors sous-traitance par l’association) peut se faire de trois manières différentes :
En autonomie
Via l’association (Apport d’Affaires)
En tant que salarié·e formé·e au sein de son organisation (aussi appelé·e animateur·rice interne)

\uD83D\uDCD8 En autonomie : j’ai facturé une prestation, intégrant La Fresque du Climat (atelier et/ou formation)
➡️ Chaque Fresqueur·euse est libre de prospecter de son côté et de proposer des ateliers Fresque du Climat indépendamment de l’association, en passant en direct avec une organisation.
➡️ Aucun pré-requis n’est fixé par l’association pour intervenir (expérience bénévole fortement recommandée - facilitation de formation à l’animation à partir de la ceinture verte).

Il n’est pas obligatoire d’avoir suivi la formation professionnelle de 7H pour te lancer dans une activité professionnelle. Si tu as seulement suivi la formation de 3h, tu peux consulter les supports de celle de 7h dans les ressources de la page pro. |
➡️ Tu dois t’acquitter des droits d’utilisation de 10% HT sur le chiffre d’affaires HT généré par l’utilisation de l’outil.

\uD83D\uDCD8 En Apport d’Affaires via l’association : j’ai facturé une prestation, intégrant La Fresque du Climat (atelier et/ou formation)
➡️ L’association reçoit des demandes de la part d’organisations et les attribue soit en Sous-traitance soit en Apport d’Affaires (pour en savoir plus lire cet article).
➡️ Dans le cadre de l’Apport d’Affaires, les demandes entrantes des organisations sont renvoyées directement à la communauté des Fresqueur·euses pros via l’espace animateur·ice (onglet “Pro”, rubrique “Opportunités en cours”). L’association n’a pas eu de contact préalable avec le prospect; il revient à la personne qui obtient le lead de gérer la relation commerciale et de contractualiser directement avec le·la client·e.
➡️ Tu dois t’acquitter des droits d’utilisation de 10% HT sur le chiffre d’affaires HT généré par l’utilisation de l’outil. À cela, s’ajoutent les droits d‘apport d’affaires, car le lead a été obtenu suite à l’attribution d’une demande entrante par l’association (également 10% HT sur le chiffre d’affaire HT).

According to a licence agreement dated 10 July 2019 extended by amendment on 13 November 2023, the Author has granted the association “La Fresque du Climat” the exclusive rights to use the French trademark “La Fresque du Climat” and the game “La Fresque du climat”. As a result, the association may define the conditions of use of La Fresque du Climat and collect the royalties for commercial use or use within an organisation. |
The use of the “Climate Fresk” workshop in a professional setting (excluding opportunities subcontracted with the association) can be done in three different ways:
Autonomous prospection
Via the association (opporunities dealt as “Business Contribution”)
As an employee trained within your organisation (also called an “internal facilitator”)

\uD83D\uDCD8 Autonomous prospection: I invoiced a service including Climate Fresk tools (workshop/training/etc.)
➡️ Each Fresker is free to prospect on their own and offer Climate Fresk workshops independently of the association, by going directly to organisations.
➡️ No prerequisite is set by the association to facilitate (we recommend you to have a strong experience as a volunteer facilitator - if you wish to offer trainings, you will have to be a green belt at minimum).

It is not mandatory although highly recommended to be trained with the 7-hour professional training to start offering your services in a professional context. If you only followed the 3-hour training, you can check the materials for the 7-hour training in the resources of the pro page. |

\uD83D\uDCD8 Business Contribution via the association: I invoiced a service, integrating Climate Fresk tools (workshop/training/etc.)
➡️ The association receives incoming requests from organisations and allocates them to freskers as either Subcontractors or Business Contributions (to find out more, read this article).
➡️ When opportunities are dealt as Business Contribution, incoming requests from organisations are sent directly to the professional fresker community via the facilitator space (“Pros” tab, “Pending Opportunities” section). In this case, the association did not have prior contact with the prospects; the person who gets the lead is in charge of managing the business relationship and reaching out directly to the prospect.
➡️ You will have to declare the 10% usage fee (excluding tax) on the turnover (excluding tax) generated by using the tool. To this, you will have to add business contribution fees, for you were introduced to the lead via the incoming requests of the association. The amount of this fee will also be 10% excluding tax on turnover (excluding tax).

En tant que salarié·e d’uneAs an employee of an organisation*:
j’ai animé et/ou formé sur mon temps de travail (en interne ou en externe)➡️ Une fois formé·e à l’animation au sein de ton organisation, tu es libre d’animer des ateliers à tes collègues (notamment dans le cadre d’un déploiement) : il n’y a pas de pré-requis (même si nous conseillons fortement de s’entrainer en amont et / ou d’avoir recours à une session de coaching sur ton premier atelier).
➡️ Ton organisation doit s’acquitter du règlement des droits d’utilisation de 3€ HT (3,60€ TTC) par participant·e.

I have facilitated/trained during my working time (internally or externally)
➡️ Once you have been trained as a facilitator within your organisation, you are free to facilitate workshops to your co-workers (especially if Climate Fresk is rolled-out in your organisation): there are no prerequisite (we nevertheless strongly recommend you to facilitate beforehand and/or have a mentor to support you while you facilitate for the first time ) .
➡️ Your organisation will have to declare usage fees : 3€ excluding tax (€3.60 including tax) or €5 excluding tax (€6 including VAT) per participant.
*except if you facilitated within an educational institution or for the general public

The amount will remain unchanged for public sector organizations and associations other than professional associations. For Switzerland, the fees will be 10 CHF from January 2025. |
